1. Agreement to Terms
By accessing or using apexaureus.co (the "Site") or purchasing any services from Apex Aureus ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Site or purchase our services.
2. Services
Apex Aureus provides custom-built prospect contact lists ("Lists") to financial advisors and other professionals. Lists are delivered digitally via email in CSV format within 3–5 business days of order confirmation.
All Lists are built based on criteria specified by the customer at the time of order. We do not guarantee specific results, appointment rates, or conversion outcomes from the use of any List.
3. Orders & Payment
All orders are subject to acceptance by Apex Aureus. We reserve the right to refuse or cancel any order at our discretion. Payment is due in full at the time of order placement. All prices are listed in US dollars.
Payments are processed securely through Stripe. By placing an order, you authorize us to charge the payment method provided for the full order amount.
4. Refund Policy
Due to the custom nature of our services, all sales are final. We do not offer refunds once a List has been delivered. If you believe there is a significant error in your delivered List — such as incorrect geography or target market — contact us within 5 business days of delivery at tristan@apexaureus.co and we will review and make reasonable corrections at no additional charge.
5. Delivery
Lists are delivered to the email address provided at the time of order within 3–5 business days. We will contact you prior to delivery if we have questions about your criteria. Apex Aureus is not responsible for delivery failures caused by incorrect email addresses or spam filters.
6. Acceptable Use
By purchasing a List from Apex Aureus, you agree to use it in compliance with all applicable laws and regulations, including but not limited to:
- The Telephone Consumer Protection Act (TCPA)
- The CAN-SPAM Act
- Do Not Call (DNC) registry requirements
- Any applicable state telemarketing laws
You are solely responsible for ensuring your use of any List complies with applicable law. Apex Aureus assumes no liability for how purchased Lists are used.
7. Data Accuracy
We make reasonable efforts to provide accurate and current contact data. However, we do not warrant that any List will be 100% accurate, complete, or error-free. Contact information changes frequently and Apex Aureus is not liable for outdated, incomplete, or inaccurate data.
8. Intellectual Property
Lists purchased from Apex Aureus are licensed for your personal business use only. You may not resell, redistribute, sublicense, or share any List with third parties without our prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law, Apex Aureus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or any List purchased. Our total liability to you for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim.
10. Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that our services will meet your specific business requirements or produce any particular outcome.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Arkansas.
12. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
